The offer and sale of products on our website ("www.bestwind.it") are governed by these Sales Conditions. The products purchased on www.bestwind.it are sold directly by BestWind SRL. BestWind is registered with the Chamber of Commerce Industry Crafts Agriculture of Verona, VAT number 04762880237. BestWind's headquarters is in Italy, at Via Gardesana, 294 - 37018 Malcesine (Verona). You can request any information from Best Wind through the contact page or by calling us directly at +39 045-7400075 or by sending an email to sail@bestwind.it. BestWind offers for sale, through the website www.bestwind.it, products and carries out its electronic commerce activity towards its final users, whether they are "consumers" or commercial activities. These Sales Conditions exclusively regulate the offer, forwarding, and acceptance of purchase orders for products on www.bestwind.it Your order will be archived in our database for the time necessary to process orders and in any case within the terms of the law. The language available for concluding the contract is Italian. Best Wind may not proceed with your purchase orders if there are not sufficient solvency guarantees or for orders that are incomplete or incorrect, or in case of product unavailability. In these cases, we will inform you by email that the contract is not concluded and that BestWind has not followed up on your purchase order specifying the reasons.
PLEASE NOTE THAT DURING THE MONTH OF AUGUST AND HOLIDAYS (CHRISTMAS, EASTER, ETC.) WE CANNOT GUARANTEE NORMAL SHIPPING SERVICE, NOR THE COMPLETE AND IMMEDIATE AVAILABILITY OF ITEMS DUE TO THE CLOSURE OF COMPANIES AND OUR SUPPLIERS.
Purchase Contract
To conclude the purchase contract for one or more products on bestwind.it, a minimum order value of 30 euros (VAT included) excluding shipping costs is required. You will need to fill out the order form with all the required information, confirm the terms and conditions, and submit the order, all following the guided procedure on the website. Before confirming and sending the order, you will be presented with a summary of the items you have selected, with a description of each product, quantity and its price, the payment method you have selected, and the delivery methods of the purchased products, shipping costs to the address you specified, and the Sales Conditions. Once the order is sent, you will receive an automatic email confirming receipt of the order from BestWind with a summary containing: name, quantity, color, and price of the items; payment method and shipping costs to the address provided by you. This email does not automatically confirm the availability of all the items you selected. If you do not receive further communications, an email will be sent to you when the courier picks up your package from our store. Otherwise, if some items are not available, you will be notified as soon as possible (and within the opening hours of our stores).
Once the order form is confirmed and submitted: • you unconditionally accept the terms and conditions described on this page; • you unconditionally confirm the correctness of the data and shipping and billing address provided by you in the order form; • you unconditionally confirm that you want to purchase the selected items and are aware of their characteristics, color, size, fit, dimension, quality;
Please remember that for any doubts or consultancy you can contact us at one of our stores, open every day (+39 045.7500075 - sail@bestwind.it). If the products presented on bestwind.it are no longer available after the customer has submitted the order form, it will be BestWind's responsibility to promptly communicate to you (at the email address or phone number provided at the time of ordering) the possible unavailability of the ordered products and propose a valid alternative, or the refund of the unavailable items if the proposed alternative does not meet your needs. The refund will be made by bank transfer and will be equal to the amount indicated in the order form for that specific item (in case of partial refund of the order) or the total amount paid by you (in case of cancellation of the order). If you choose to accept an alternative to the unavailable product, you will be refunded the price difference (in case the new item costs less than the one you already paid for) or you will be asked to pay the difference (if the new item costs more than the one previously purchased).
The contract is concluded when BestWind receives your order, confirms the availability of the products, and ships the items you purchased. The order form will be archived in our database for the time necessary to process orders and in any case within the terms of the law. You can access your order form by consulting the "order history and details" section on your personal account, where you can also view the progress of the order. If you do not agree with some of the terms stated in the Sales Conditions, we invite you not to submit the order form.
Guarantees and indication of product prices
bestwind.it offers for sale clothing items, technical equipment, and accessories from various brands related to the world of sailing, windsurfing, and boating. Each product has been carefully selected and purchased by BestWind from authorized distributors, manufacturers, and retailers. Items that are not specified as "USED" (some sails, boards, booms, masts, boats) are new, unused, and intact. The characteristics of the products are described on bestwind.it within each product sheet with descriptions and images. The desired color and size must be specified by selecting them from the drop-down menu of the product sheet. However, colors may not correspond exactly to the real ones due to the monitor or photographic rendering. Product prices may be subject to updates. Make sure of the final sale price before submitting the order form. BestWind, in case of exercising your right of withdrawal, has the option of not accepting the return of items without proof of purchase (receipt), or their packaging, labels, and seals present at the time of shipment, or items that have been altered or damaged.
Payments
You can select the preferred payment method before submitting the order form. The total price will include shipping costs calculated based on the weight of the package and the delivery address provided by you. STRIPE: In case of payment by credit card, all payment information (credit/debit card number, expiration date, cardholder) will be securely processed through the STRIPE circuit, a company that provides distance electronic payment services, without third parties having access to them in any way. PAYPAL: In case of payment via Paypal, the user will be redirected to the secure Paypal system where they can make the payment simply using their Paypal account credentials. SCALAPAY: In case of payment via Scalapay, the user receives the order immediately and pays in 3 installments. The user acknowledges that the installments will be assigned to Incremento SPV S.r.l., related subjects, and their assignees, and authorizes this assignment.
Order processing times
BestWind undertakes to process each order as quickly as possible. Normally, for orders relating to items currently available in our warehouse, received by 10:30 am, we will do our best to process them on the same day (if working) or the next working day if the order was received on a holiday. Orders received after 10:30 am, or on a holiday or eve, will be processed the next (working) day. In case one or more items are not currently available, you will be notified by email during the day. For orders paid by BANK TRANSFER, the order processing times are considered from the moment BestWind receives proof of payment. To expedite the process, please send us a copy of the bank transfer receipt to the address ordini@bestwind.it indicating the order number. If you do not receive a response or confirmation of the order, please consider the online sales department hours: Mon-Fri 9:30 am-1 pm. Our store is open every day from 9:30 am to 8 pm (including Sundays and holidays) for any questions or advice, do not hesitate to contact us.

Right of withdrawal - RETURNS
You have the right to withdraw from the contract concluded with BestWind, without any penalty, within 14 working days from the day you received the products purchased on bestwind.it. You will need to return the products, which must arrive at one of our stores within 30 working days from when you received the products. The only expenses you will have to bear are the shipping costs for returning the purchased products.
The Right of Withdrawal is considered exercised correctly if the following conditions are fully met: • the products must be returned intact without having been used, worn, or damaged; • the products must be returned in their original packaging complete with all their elements and accessories, accompanied by the instructions/notes/manuals attached, original packaging and labels, and the warranty certificate, if any, with original labels not removed, and with the related proof of purchase (receipt) • the products must arrive at our store INTEGRALLY in undamaged packaging. It is the customer's responsibility to ensure that the items are packaged in suitable transport packaging, which do not fall apart, causing the loss or damage of the items themselves. BestWind reserves the right to refuse apparently damaged packages, and disclaims any responsibility in case of loss or damage to the items during transportation. In case of lost items due to inadequate packaging, no refund will be made by BestWind.
We will activate the refund procedures once we have received the return items, and verified the correct execution of the terms and conditions indicated above. The amounts will be refunded to you as soon as possible and, in any case, within thirty days from your withdrawal request. The amount to be refunded is net of the shipping costs for the delivery of the purchased products.
If the methods and terms for exercising your right of withdrawal, as specified above, are not respected, you will not be entitled to a refund; however, you can reclaim the products at your own expense, in the state in which they were returned to us. Otherwise, BestWind may retain the products, in addition to the amounts already paid for their purchase.
BestWind will also refund you the shipping costs for the delivery of the purchased products (in addition to the product amounts) only if the return of the products occurs due to reasons attributable to BestWind, such as when the products do not have the essential characteristics promised (for example, different color or size from those indicated), or present manufacturing defects. In any case, these reasons must first be verified by BestWind upon receipt of the return items. Only after this verification, you will be refunded both the shipping costs and those related to the returned item via bank transfer. You will be asked to provide us with an IBAN.
How to request a return or exchange
To proceed with the return or refund request, please make sure that your request meets the terms and conditions described above, then you can contact us and communicate your request (by phone or email ordini@bestwind.it). We will then send you via email the return/cancellation form with all the instructions, terms, and conditions, which you will need to forward to us once completed to the same address from which you received it.
Refund times and methods
After returning the products, BestWind carries out the necessary checks regarding their conformity to the conditions and terms indicated in the paragraph above. In case the checks are positive, we will send you, via email, the confirmation of acceptance of the returned products. Regardless of the payment method you used, the refund will be made by bank transfer. You will be asked to provide us with your IBAN. The refund will be activated within thirty days from the date BestWind becomes aware of your withdrawal request, after verifying the correct execution of your right of withdrawal and acceptance of the returned products. You will bear the shipping costs (see "right of withdrawal" section), including responsibility in case of loss or damage to the products.
Applicable law
The Sales Conditions are governed by Italian law and in particular by Legislative Decree 22 May 199 n. 185 on distance contracts and Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce.
Modification and updating
The Sales Conditions are modified from time to time also in consideration of any regulatory changes. The new Sales Conditions will be effective from the date of publication on www.bestwind.it.
